Terms of Service

1. Acceptance of Terms

By accessing or using Kaya Recruit ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. These terms constitute a binding agreement between you ("the Agency" or "User") and Job Holdings (Pty) Ltd ("we", "us", "Kaya Recruit"), a company registered in South Africa.

2. Description of Service

Kaya Recruit is a cloud-based recruitment management platform providing AI-assisted CV screening, candidate pipeline management, job description generation, POPIA compliance tools, and related recruitment automation features. The Service is provided on a subscription basis to registered recruitment agencies and HR professionals.

3. Subscription and Payment

Access to the Service requires a paid subscription after a 14-day free trial. Subscription fees are billed monthly or annually as selected at signup, via PayFast. All prices are in South African Rands (ZAR) and exclude VAT unless stated otherwise. Subscriptions automatically renew until cancelled. You may cancel at any time by contacting support@kayarecruit.co.za. No refunds are issued for partial billing periods.

4. Acceptable Use

You agree to use the Service only for lawful recruitment purposes. You may not: (a) use the Service to discriminate unlawfully against candidates; (b) process candidate data without valid POPIA consent; (c) resell or sublicense access to the Service; (d) attempt to reverse-engineer or circumvent security measures; (e) upload malicious content or interfere with the platform. We reserve the right to suspend accounts that violate these terms.

5. Data and POPIA Compliance

You are the Responsible Party under POPIA for all candidate personal information processed through your account. Kaya Recruit acts as an Operator. You must ensure you have valid consent from all candidates whose data you upload or process. Candidate data is retained for the duration of your subscription plus 30 days after cancellation, after which it is permanently deleted.

6. AI Features and Accuracy

AI-generated outputs (CV scores, job descriptions, interview questions, candidate summaries) are provided as decision-support tools only. They do not constitute professional advice. You remain solely responsible for all hiring decisions. We recommend human review of all AI-generated content before use in employment decisions.

7. Intellectual Property

The Kaya Recruit platform, brand, and underlying technology are owned by Job Holdings (Pty) Ltd. You retain ownership of data you upload. By uploading content, you grant us a limited licence to process it solely to provide the Service. We do not use your data to train AI models.

8. Limitation of Liability

To the maximum extent permitted by South African law, Kaya Recruit shall not be liable for any indirect, incidental, or consequential damages arising from use of the Service. Our total liability shall not exceed the subscription fees paid in the 3 months preceding the claim.

9. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.
